Terms and conditions
By accessing our website, you are agreeing to be bound by these terms of service, and agree that you are responsible for compliance with any applicable local laws.
These terms and conditions (the “Terms”) are a contract between you and DrumKit Labs Ltd (“DrumKit”, “we”, “us”) that governs your use of drumkit.design, the DrumKit design tool, its plugins and everything else we provide (together, the “Service”). By creating an account, clicking accept or using the Service you agree to them. If you are accepting on behalf of a company, you confirm that you have the authority to bind it.
We update these Terms from time to time. Small changes take effect when we publish them; material ones are announced by email and in the product at least 30 days before they apply, and if you keep using the Service after that date you accept the new version. This version is current as of 20 Jan 2027.
What information do we collect?
Account information. To provide the Service we need an email address, a display name and either a password or a sign-in token. You must keep these accurate and keep your password to yourself; everything done under your account is treated as done by you until you tell us otherwise.
Your content. Files, components, comments and any other material you upload or create (“Content”) remain yours. You grant us a licence to store, copy, render, back up and transmit Content solely to operate the Service and to show it to the people you share it with. We claim no other rights in it, and the licence ends when you delete the Content, subject to the retention periods in our privacy policy.
Usage and billing information. We record how the Service is used and, for paid plans, the billing details needed to charge you. How this information is handled is described in the privacy policy, which forms part of these Terms.
How do we use your information?
To provide and bill the Service. Paid plans are billed in advance, monthly or yearly, at the price shown when you subscribe. Prices may change with 30 days’ notice and never mid-term. Fees are non-refundable except where the law says otherwise or where these Terms say so, and unpaid invoices may lead to the workspace being suspended after 14 days’ notice.
To enforce acceptable use. You may not use the Service to break the law, infringe anyone’s rights, distribute malware, send spam, scrape other users’ Content, probe our security without permission, or resell access without a reseller agreement. Community plugins must follow the plugin guidelines. We may remove Content or suspend accounts that break these rules, and we will tell you why unless the law prevents it.
To improve the Service. We use aggregated, de-identified usage information to develop new features and to test changes. We do not train machine learning models on your Content unless you opt a workspace in from its settings, and you can opt out again at any time.
Do we use cookies and other tracking technologies?
Yes, as described in the privacy policy. Cookies that are strictly necessary to sign you in and remember your preferences cannot be refused without breaking the Service; every other kind can be refused from the cookie banner or from Settings, then Cookies, without losing access to anything you have paid for.
How long do we keep your information?
Your Content is kept for as long as your account or workspace exists. If a paid plan lapses the workspace becomes read-only for 60 days, after which Content beyond the free plan’s limits is archived for a further 90 days and then deleted. You can export everything at any point before that. Account closure deletes personal information within 30 days, subject to the retention periods in the privacy policy.
How do we keep your information safe?
We provide the Service with reasonable skill and care and with the safeguards described in our security overview, but the Service is provided “as is”. To the fullest extent the law allows, we exclude all other warranties, and our total liability to you in any twelve-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability for death, personal injury, fraud or anything else that cannot lawfully be limited.
What are your privacy rights?
The privacy policy sets out the rights you have over your personal information and how to exercise them, and nothing in these Terms takes any of them away. In addition, you may cancel a subscription at any time from Settings, then Plan; the plan runs to the end of the period already paid for. If we make a material change to these Terms that you do not accept, you may close your account within the notice period and we will refund any prepaid fees for the unused part of the term.
How can you contact us about this policy?
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that consumers may rely on the mandatory law of the country they live in. Questions, notices and disputes go to legal@drumkit.design or to DrumKit Labs Ltd, 4 Beat Street, Manchester M1 2AB, United Kingdom. Before either of us starts proceedings we agree to:
- Raise the issue in writing with enough detail for the other side to understand it.
- Allow 30 days for a good-faith attempt to resolve it, including a call between people with authority to settle.
- Try mediation through a recognised UK provider if that fails, sharing the cost equally.
